A three-judge Supreme Court bench headed by Justice AK Sikri will hear the Congress-JD(S) petition at 1:45 am tonight against Governor Vajubhai Vala's invitation to BS Yeddyurappa to form the government in Karnataka.

Secretary General Ravindra Maithani and Supreme Court registrar have reached the residence of Chief Justice Dipak Misra to discuss the Congress-JD(S) petition against the swearing. Congress' Abhishek Manu Singhvi has also reached the CJI residence. The Congress had moved the Supreme Court, asking for a stay on the swearing-in ceremony of BS Yeddyurappa scheduled for Thursday morning at 9.30am. The party has asked for an urgent hearing tonight after Governor Vajubhai Vala invited the BJP to form the government first, ahead of the JDS-Congress combine. The governor has given the BJP 15 days to prove it has a majority in a floor test. The governor took the decision after consulting with former Attorney General Mukul Rohtagi, who favoured inviting the single largest party first, in this case, the BJP.

Justice SA Bobde said, "we do not know what kind of majority BS Yeddyurappa has claimed. Unless we see that letter of support, we cannot speculate", while hearing the petition filed by Congress & JD(S) challenging Karnataka Governor's decision #KarnatakaElectionsKarnatakaStateElections2018.png

The matter shouldn't be heard in the night. Heavens won't fall if someone is sworn in. Last time SC heard in night, the case related to hanging of Yakub Memon: M Rohatgi, BJP's lawyer tells court in hearing of plea filed by Cong & JD(S) challenging Karnataka Governor's decision
