An over enthusiastic T Higher Education Commission went to High Court claiming that post bifurcation all properties and cash in Bank accounts of AP Higher Education will henceforth belong to Telangana only. An equally biased judgement came from joint High Court. Now Supreme Court says 'Nothing Doing ' ... and stuck down the Judgement of High Court. .!! This is the first victory for Andhra people and atleast in this background the Institutions numbering 150 plus in Schedule 9 and 10 of AP Reorganisation Act should be divided either based on population or any mutually agreed pattern. Telangana cannot henceforth say that everything that was in Hyderabad before bifurcation will completely belong to T and AP cannot get a share in it. Supreme Court of India has said now that such a notion is wrong, unconstitutional and not according to the AP Reorganisation Act. sonykongara Posted March 18, 2016 Share Posted March 18, 2016 ఉన్నత విద్యామండలి కేసులో ఏపీకి వూరట దిల్లీ: ఉన్నత విద్యామండలి కేసులో ఆంధ్రప్రదేశ్‌కు సుప్రీంకోర్టులో వూరట లభించింది. ఆంధ్రప్రదేశ్‌, ఉన్నత విద్యామండలి అప్పీళ్లను సర్వోన్నత న్యాయస్థానం అనుమతించింది. జస్టిస్‌ గోపాలగౌడ, జస్టిస్‌ అరుణ్‌మిశ్రాలతో కూడిన ధర్మాసనం ఉన్నత విద్యామండలి కేసులో శుక్రవారం తీర్పు వెలువరించింది. గతంలో హైకోర్టు ఇచ్చిన తీర్పును అత్యున్నత న్యాయస్థానం పక్కనపెట్టింది. తీర్పులోని ముఖ్యాంశాలు * రాష్ట్ర విభజన తర్వాత ఆస్తులు, అప్పులు ఇరు రాష్ట్రాలకు పంచాలి * పంపకాలు జరపనట్లయితే సెక్షన్‌ 45 నిరుపయోగం అవుతుంది * ప్రజా ప్రయోజనాల దృష్ట్యా పంపకాలు తప్పవని సుప్రీంకోర్టు స్పష్టం చేసింది. * సెక్షన్‌ 75 ప్రకారం తమకే చెందుతాయన్న తెలంగాణ వాదనను న్యాయస్థానం తిరస్కరించింది. * సెక్షన్‌ 75 కేవలం సేవలకు సంబంధించిందే * విభజనకంటే ముందు ఉన్న ఖాతాలను 52:48 నిష్పత్తిలో పంచుకోవాలి * పంపకాలు చేయని పక్షంలో కేంద్ర దృష్టికి తీసుకురావాలి *సమస్యపై రెండు నెలల్లో కేంద్రం నిర్ణయం తీసుకోవాలి * విభజన తర్వాత 13 జిల్లాల్లో తెరిచిన ఖాతాలను ఏపీ నిర్వహించుకోవచ్చు. *పదో షెడ్యూల్ల్‌ని అన్ని సంస్థలకు తీర్పు వర్తిస్తుందని ఏపీ తరపు న్యాయవాది కోర్టు దృష్టికి తెచ్చారు.
