Hearing commences. Attorney General KK Venugopal requests the judges to use the microphone. @KapilSibal commences his arguments.

 

Congress MLAs arrived at Vidhana Soudha. Floor testto be held at 4 pm today

 

JD (S) is confident of keeping its MLAs. Doubts are on congress MLAs!!!

 

Kapil Sibal: It is an established principle that the senior most member shall be appointed as the pro tem speaker. Convention formed by the SC are laid down in two landmark judgements and also laid down in practices of the parliament.

Congress-JD(S) and 2 independent MLAs are with us. I don't think they (BJP) can manipulate: Veerappa Moily,

 

Justice SA Bobde points out there have been instances where the senior most member of the House wasn't the pro tem speaker. Rohatgi supports this view, saying he and Sibal have once argued for a member as pro tem speaker who was the junior most.

Kapil Sibal is reading out observations from an old judgement against KG Bopaiah. We would have never come to the lordships if the protocol was followed.

 

Justice SA Bobde: If you want us to consider specifically this issue then we must issue notice to him & hear him too.

In history of this country the only time a protem was asked to take a trust vote was in Jharkhand

 

Sikri J: yesterday you suggested that a protem should be appointed. You asked us to appoint a protem speaker

 

Sibal: we didn't know then that convention would be violated

Supreme Court to Sibal in Karnataka floor test: You are in a zone of contradiction. You want to militate against the pro tem speaker but not willing to give him time to respond. We will hear you but then floor test will have to be delayed
