H1B Work Permit Holders ki Important Info.

Donald Trump put out certain restrictions on work permit holders today by adding new terminology and clauses to existing EO (executive order) which was issued on April 22, 2020.

Two lines lo matter:

EO suspends the entry of H-1B, and H-4 H-2B, J-1, and L-1 and L-2 visa holders who are currently outside the United States and does not have a nonimmigrant visa that is valid on the effective date of this proclamation.

This means that if you are in US currently in workpermit, you are ok to stay and continue to work. If you go outside US having above workpermit then you won't be issued new work permit VISA until Jan 2, 2021.

This Executive Order does not apply to:

  • F-1 Students, OPT, STEM OPT
  • H-1B/L-1 petitions filed with USCIS
  • TN, B-1, E-3, O-1 and other temporary work visa holders
  • Cap-subject H-1Bs filed with USCIS
  • Any application filed with USCIS
  • Student visa applications at a consulate or embassy
  • In other words, you can continue filing any application with USCIS (including PERM with the Department of Labor) that you intended to file before the executive order.
  • You will not be able to apply for nonimmigrant visas at consulates or embassies once they re-open to the public.
  • If you are currently in the US, these additional measures impacting nonimmigrant visa availability should be seriously considered before making any plans for travel outside the US.
  • EO excludes food supply chain workers

most of the people will plan immediately after landing, mostly it will impact the people who planned the first 2 weeks of lockdown.

People who have landed in India for stamping are impacted. Tough times until Dec. 2020.

Individuals are EXEMPT from the visa issuance restrictions if:

They were physically inside the United States at 12:01am EDT on June 24, 2020; or
They held any valid US visa (including a business or tourist visa) as of 12:01am EDT on June 24, 2020; or
They are a citizen of Canada.

 

Only Very New H1Bs(coming directly from outside) ki restriction...

Exemptions and waivers

The following categories of foreign nationals are exempt from to the entry ban:

Foreign nationals present in the United States at 12:01am EDT on June 24, 2020.  This includes those in the United States awaiting a change of status under the FY 2021 H-1B cap;

Foreign nationals holding a valid visa, advance parole or other U.S. travel document on June 24, even if they are outside the United States when the ban takes effect;

U.S. lawful permanent residents;

The spouse or child of a U.S. citizen;

J-1  exchange program participants other than interns, trainees, teachers, camp counselors, au pairs and summer work travel participants; and

Foreign nationals entering to provide temporary labor or services essential to the U.S. food supply chain.

The proclamation also provides for discretionary waivers of the restrictions for foreign nationals whose entry would be in the U.S. national interest, including those who are necessary to facilitate the immediate and continued economic recovery of the United States, those involved with clinical care or  research related to the diagnosis, treatment and prevention of COVID-19, and those who are critical to the defense, law enforcement, diplomacy or national security of the United States.

Waiver procedures are expected to be developed by the State Department in consultation with the Departments of Labor and Homeland Security. Waivers are to be decided on a case-by-case basis and are likely to be challenging to obtain
