Labour commissioner issues notice to firm, warning of action if it fails to revise its decision

While both the central and state governments have been repeatedly urging individuals and private organisations to not remove workers and employees from their jobs amid the lockdown and instead pay them their salaries in full, several information technology (IT) companies across the country seem to have defied the mandate put forth by the government agencies that strictly prohibit organisations from laying off their employees, slashing their salaries or compelling them to go on leaves. Capgemini Technology Services, which has some three branches across the city, too had reportedly flouted the rulings and asked its employees to take forced leaves. The IT major has now received a notice from the labour commission to revoke the revised leave policy, failing which the firm is likely to face strict action.

The notice issued by the labour commissioner’s office to the IT giant clearly states that if the older leave plan is not reinstated, the company will face action under the Disaster Management Act, 2005.


On April 8, Mirror had reported that around 2,000 employees working for the firm across three facilities in Pune and Pimpri-Chinchwad, at Talawade, Kalyani Nagar and Hinjawadi, had been informed by the company in the first week of April that the leaves for the first half of the year have been tweaked, cancelling the earned leaves until the end of June.

While those employees on bench were compelled to apply for an immediate leave for a period of a fortnight, which, in turn, resulted in loss of pay for many.

Employees had approached the labour commission for redressal and, accordingly, National Information Technology Employees Sena (NITES), a labour union working for the rights of IT employees, had written to Chief Minister Uddhav Thackeray.

An employee from the firm said on condition of anonymity, “Initially, we approached our senior management to resolve the matter, but we didn’t receive a positive response. Therefore, we had to knock on the door of the labour commissioner. As of now, we have not heard from the company administration regarding further revision on the leave policy.”

An employee from the Talawade branch said, “The appraisals this year already got affected. The least we could expect was to be allowed to take leave when needed.”

Harpreet Singh Saluja, a member of NITES, said, “During this critical time when the government is trying to protect the interest of employees, Capgemini’s move is illegal and attempts to deduct wages by forcing employees to apply leave without pay.”

The notice sent by assistant labour commissioner Sameer Chavan states, “According to government regulations, the company cannot deny employees their right to salaries and other benefits amid the pandemic.”


“If the company fails to follow the rules, an action will be taken under section 51 of the Disaster Management Act, 2005.”

Vikas Panvelkar, deputy labour commissioner, told Mirror, “We have reached out to the company, stating all the norms that need to be followed during a pandemic and informing that employees’ salaries should not take a hit.”

“We have also asked the labour union to provide us with the list of employee affected due to the decision for us to plan our future course of action,” he added.

they tried cut employees in the name of cost cutting in this period....

Completely agree with this, govt has lost that right when they deferred salaries for its employees

Em projects poledu or apaledu ee pedda companies ki anukuntunna, just kottaga ravalasina work timely ga ravatledu antee clients are postponing them..In some cases clients are asking for delayed payments kani nadustunna projects appatledu. So these big 3 or big 4, for the sake of stock price pichi veshalu ante. These companies reported thousands of crores of profits last yr, why cant they spend that on employees after all employees are their investment.
